R.W. Thompson, Inc. warrants to distributors and industrial and commercial users of its products
that each new product supplied shall be free from defects in material and workmanship. Our sole
obligation under this warranty is limited to furnishing, at its option without additional charge, a
replacement for, repairing or issuing credit for any product which within 6 months from the date of
sale, be returned freight pre-paid to R.W. Thompson, Inc. and which upon inspection by us is
determined to be defective in materials or workmanship. This warranty does not apply to any
products which have been altered, misused, subject to an accident or used beyond their normal
useful life. Failure to make any claims within such time shall constitute a waiver by buyer of all
claims with respect to such shipment. Our sole liability on any claim of any kind, whether in
contract, or otherwise, for any loss or damage connected with, or resulting from the manufacture,
sale, delivery or use of the products sold hereunder shall in no case exceed the cost of replacement
or repair as provided herein. We make no warranty that the goods do not or will not infringe the
patent and/or trademark of any third party and there is no express or implied warranty of
merchantability or of fitness for any particular purpose and disclaims any liability for incidental or
consequential damages. There are no other warranties, beyond description of the goods described
herein express or implied, made by R.W. Thompson, Inc. except the warranty against defects in
material and workmanship set forth above.
